At Freedom Treks Ltd (formerly 2 Wheel Treks Ltd) (hereinafter called "the Company", "we", or "us") we aim to treat all our customers fairly. The following booking conditions set out our obligations to you when you book with us, and also lets you know what we expect from you. All tours in our brochure or listed on our website are sold subject to the following conditions.
1) Booking a holiday. To make a booking a booking form must be completed and sent to us with a nonrefundable deposit of £50 for each person. One person, acting for the people listed on the booking form, must sign the form. Alternatively, a booking can be made by giving the requested details over the telephone. By giving us your details and indicating your desire to book with us you will be deemed to have accepted the terms and conditions of our contract. Confirmation of the booking will normally be sent within 7 working days. The booking is not accepted and no contract exists until the date shown on the confirmation invoice. Any changes that are made after the booking has been made will be subject to a fee of £20.
2) Security. For your security the Company complies with the EU travel package directive and your payments are held in a Trust account until completion of your holiday.
3) Payments. The balance shown on the invoice must be paid eight weeks prior to the commencement of the holiday. If the booking is made less than eight weeks before departure full payment must be made on booking. If the balance is not paid in time we reserve the right to cancel your holiday and apply the cancellation charges outlined below. If you pay by credit card we make a charge of 1.5% to recover the credit card charges to us. There is no charge for debit cards.
4) Cancellation by you. If you wish to cancel your holiday, this must be in writing by the person who signed the booking form or booked over the telephone and whose name is shown on the invoice. The following cancellation rates will apply: -
a. 56 or more days before departure date – deposit only
b. 29 to 55 days before departure – 50% of the holiday cost
c. Less than 28 days – No Refund
If you are unable to undertake the holiday due to circumstances that would normally permit you to make a claim on a travel insurance policy, you may transfer the booking to another person. A fee of £25 will be charged for such changes, or £50 if the change is less than 28 days before departure date.
5) Cancellation by us. We will not cancel a holiday unless
a. We are forced to do so by unusual or unforeseen circumstances, war, civil or political unrest, or what is usually known as "force majeure" or
b. If the minimum number of people required to operate our holidays has not been reached. In this case we will inform you no less than 28 days before departure date.
If we do decide to cancel a tour we will, if possible, offer an alternative tour. If this is not acceptable to you then a full refund will be given. However we will not be liable to refund any incidental expenses you may have incurred as a result of your booking, such as flights, travel insurance, visas, additional travel arrangements, etc.
6) Minimum Number. If the number of people booked on a guided tour is less than the minimum number required to run the holiday, and would normally cause us to cancel the trip, we reserve the right to reduce the number of staff accompanying the group instead of cancelling the holiday. You will be advised of any changes prior to the start of the tour.
7) Prices of holidays. Prices featured in our brochure or listed on our website may change at any time due to changes in exchange rates, increases in transport, accommodation or other costs, or if government action forces us to do so. Once a confirmation invoice has been issued we will endeavour to abide by that price. Once the holiday has been paid in full we will absorb any subsequent price increases or surcharges.
8) Risks and Hazards. Your booking is accepted on the understanding that you realise the risks and hazards of such a holiday, including the dangers inherent in cycling either on the road or off the road, or the dangers inherent in the other activities included in individual holidays. It is your responsibility to ride with due care at all times. If in doubt you should walk where you are not confident to ride. Your booking is accepted on the understanding that you realise the risks of such holidays in terms of potential for delay and alterations, due to possible changes in local politics, weather, border restrictions, disease, loss or damage to property, inconvenience and discomfort.
9) Information. Any information given by the Company on matters such as visas, vaccinations, climate, clothing, special equipment, topography, etc. is done so in good faith and without responsibility on our part.
10) Passport and Visas. All clients are personally responsible for ensuring that they have a valid passport, any necessary visas and conform to the health regulations regarding vaccinations. We recommend that all clients based in the UK, obtain a copy of the DHSS booklet “Health Advice for Travellers” (available at the Post Office). All travellers from the UK should obtain a European Health Insurance Card (EHIC)
11) Problems. Our responsibility does not commence until the appointed time at the designated meeting point. If you fail to arrive at the designated meeting point at the appointed time, for whatever reason, we will not be responsible for any additional expenses incurred by you to start the tour. No refund or compensation will be given for any unused portions of the holiday, including travel arrangements, accommodation, food and services, should a customer be unable or choose not to complete a tour. For these holidays we act as booking agents and cannot be held responsible should there be a failure of any establishment or operator to provide the accommodation booked.
12) Responsibilities. All participants must agree to observe local laws and customs and abide by the authority of any tour leader. Signing our booking form signifies your agreement to this and therefore during a tour if your behaviour is detrimental to the safety and welfare of the group as a whole the tour leader may ask you to leave the tour without the right to a refund. If you are affected by any condition, medical or otherwise, that might affect your or other people’s enjoyment of the tour, you must advise us of this at the time of booking. It is a fundamental condition of joining any of the tours described in this brochure that you accept the potential hazards and the need for flexibility, and acknowledge that delays and alterations and their results such as inconvenience, discomfort or disappointment, are possible. If you bring your own bike you are responsible for keeping it in good working order. You should keep valuables safely with you at all times.
13) Complaints. We are committed to providing excellent care for our guests. However, any complaints regarding a guided tour should be made to the tour leader who will normally take the appropriate action. If at the end of the tour you feel that your complaint was not dealt with satisfactorily you must notify us of your complaint in writing within 15 days of the completion of the tour. On self-guided tours, any complaint regarding accommodation, food etc. should be made to the owners or manager of the establishment concerned at the time of your stay and a letter outlining the complaint sent to us on your return. Any other complaint should be made in writing within 15 days of your return.
All complaints that are received are thoroughly investigated and guests are kept informed. Sometimes investigations can take time, especially when awaiting a response from suppliers. We aim to settle all complaints amicably.
14) Liabilities. The Company shall not be held liable
for any damages caused by the total or partial failure to
carry out the contract if such failure is
a. attributable to the customer
b. unforeseeable or unavoidable and attributable to a third party unconnected to the Company
c. as a result of unusual unforeseeable circum stances beyond our control such as strikes, war, civil or political unrest or government action or what is usually known as "force majeure".
d. a result of an event that we, with all due care, could not foresee or forestall
e. due to the theft of bicycles
f. injury as a result of cycling either on or off road and in particular injuries as a result of inadequately maintained and serviced personal equipment or failure to wear the correct safety equipment most notably cycle helmets. Where the Company is found liable for damages in respect of its failure to carry out the contract, the amount is limited to the price of the tour.
15) Information. The information contained in our brochures and websites is to the best of our knowledge correct, all information is subject to alteration without notice. Freedom Treks accepts no liability for any inaccuracy in the information produced.
16) Personal Insurance. The client is responsible for any loss or damage to baggage, bicycles or personal possessions or any consequential loss resulting there from. You should be adequately insured against loss, theft or damage. You should keep valuables safely with you at all times. For your safety and convenience we strongly recommend that clients have travel insurance for holidays in UK. For clients booking tours in Europe travel insurance is compulsory. We offer travel insurance for UK residents or you are welcome to arrange your own. Clients from other countries must have their own travel insurance. Clients must provide on the booking form a policy number and insurance company name or choose to take the policy offered by the Company.
17) Conditions. These conditions and any contract to which they apply are governed in all respects by English Law with jurisdiction of the courts of England.
